Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Workish platform, website, and related services (the “Platform”) operated by Workish, Inc. (“Workish,” “we,” “us,” or “our”). By accessing or using the Platform, you agree to be bound by these Terms.

1. Eligibility

To create a tasker account, you must be at least 14 years old.

Individuals under 18 may only participate as taskers with verified parental or legal guardian consent.

Customers hiring taskers must be at least 18 years old.

Workish does not knowingly permit individuals under 14 to use the Platform.

2. Parental Consent

If a tasker is under 18:

• A parent or legal guardian must complete the Workish parental consent process.
• The parent affirms they have legal authority to provide consent.
• Consent may be verified electronically.
• Parents may revoke consent at any time.

Workish reserves the right to suspend or terminate minor accounts if consent cannot be verified or is withdrawn.

3. Age-Based Restrictions

To comply with applicable child labor laws, certain job categories, tools, equipment, or working hours may be restricted for taskers under 16.

Taskers and parents are responsible for ensuring that services comply with all federal, state, and local laws.

4. Workish as a Marketplace

Workish is a technology platform that connects customers with independent taskers.

• Workish does not employ taskers.
• Workish does not supervise services.
• Workish does not control how services are performed.
• Workish is not a party to agreements between users.

All service arrangements are solely between customers and taskers.

5. Safety & Conduct

Users agree not to:

• Engage in hazardous or illegal activities.
• Violate child labor laws.
• Harass, exploit, or endanger minors.
• Bypass the Platform’s payment systems.
• Provide false information.

Parents are responsible for supervising their minor’s participation and determining whether parental presence is required for specific services.

6. Payments

Payments are processed through third-party providers. Workish facilitates transactions but does not guarantee payment.

Users are responsible for taxes and compliance with applicable laws.

7. Privacy

Workish collects and processes personal information in accordance with its Privacy Policy.

For taskers ages 14–17:

• Parental consent is required before activation.
• Data collection is limited to what is reasonably necessary.
• Parents may request review or deletion of minor data.

8. Assumption of Risk

Services arranged through Workish occur in the physical world and may involve inherent risks.

By using the Platform, users voluntarily assume risks associated with arranging or performing services.

9. Disclaimer of Warranties

The Platform is provided “AS IS” and “AS AVAILABLE.”

Workish makes no warranties regarding user conduct, safety, earnings, or service quality.

10. Limitation of Liability

To the maximum extent permitted by law, Workish shall not be liable for indirect, incidental, special, consequential, or punitive damages.

Workish’s total liability shall not exceed the total service fees paid to Workish in the three (3) months preceding the claim.

11. Indemnification

Users agree to indemnify and hold harmless Workish from claims arising from use of the Platform or services performed or received.

Parents agree to indemnify Workish for claims arising from their minor’s participation.

12. Dispute Resolution

Any dispute arising under these Terms shall be resolved through binding arbitration in the Commonwealth of Virginia. Users waive participation in class actions.

13. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia.

14. Changes to Terms

Workish may update these Terms at any time. Continued use of the Platform constitutes acceptance of updated Terms.
